Staffing Agency Conspired to Harm Rival Firm, Plaintiff Alleged
Judge William Zloch issued a default judgment in favor of the plaintiff. Zloch issued an injunction prohibiting the defendant from using Nurse Finder's trade secrets or confidential information. Zloch also prohibited the defendant from contacting or otherwise interfering with Nurse Finder's prospective temporary employees for 12 months.
Plaintiff's counsel sought an injunction prohibiting the defendant from using any of the claimed trade secrets they required. Plaintiff's counsel also sought an unspecified amount in compensatory damages.
Plaintiff Nurse Finders of Arlington, Texas, with an office in Boca Raton, claimed that Across America Med Staffing of California conspired to harm Nurse Finders' business. They are rivals in the nursing staffing business.
Nurse Finders sued Across America Med Staffing for theft of trade secrets. The defendants did not appear to answer the complaint.
According to plaintiff's counsel, several principles of Across America Staffing were once employed by the plaintiff; they all signed agreements as a condition of their employment; and the agreements prohibited disclosure of lists of clients and prospective employees.
In 2006, a former Nurse Finder employee left the company and went to work for the defendant. This worker transferred confidential records from the plaintiff's computer system. The defendant used the information for its own gain. This information is not generally known to the public as it includes the candidate's personal information, as well as the needs of various corporate staffing clients.
